SPORTS MANAGEMENT SCHOOL SAS , a training organization registered under number 11 92 18308 92 with the Prefect of the Île-de-France region (hereinafter " SMS "), with a share capital of 1,000 euros, registered with the Paris Trade and Companies Registry under number 529 004 988, whose registered office is located at 11, rue de Cambrai, 75019 Paris (hereinafter " SMS "), attaches great importance to the protection and security of your personal data, in accordance with Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, regarding the protection of individuals with regard to the processing of personal data and on the free movement of such data, and the Data Protection Act of January 6, 1978, as amended.

This Privacy Policy applies to any person acting as a user of the SMS website:  www.sportsmanagementschool.fr/en/ or as learners within the institution .  

This Privacy Policy ("Policy") aims to provide you with clear and transparent information on how SMS collects and processes your personal data when you use the services provided by SMS, both within its establishments and online at: www.sportsmanagementschool.fr/en/.

This Policy also aims to inform you about your rights regarding your personal data. It is important that you familiarize yourself with this information, as well as our Cookie Policy and any other specific information notices that we may provide to you on occasion when collecting or processing personal data about you. This Policy complements these other information notices and is not intended to replace them.

Who is responsible for processing your data?  

SMS, registered under SIREN number 529 004 988, is responsible for processing the personal data that you provide through various paper or digital forms on the SMS websites, information communicated via phone, email, SMS, or through one of our paper forms, data obtained due to the relationship we have with you, and information resulting from your browsing and consumption habits.

In this Policy, the terms "SMS," "we," "our," and "us" refer to SMS.

What is the nature of the collected Data?  

The concept of "personal data" encompasses all directly or indirectly identifying information about you, whether it be information you have provided or declared (such as your contact details) or information resulting from contractual relationships you have with SMS (such as your registration). We ensure that we only collect personal data about you that is necessary for the purposes pursued.

On what occasions do we collect your Personal Data?  

In the provision of our services, SMS may be required to collect and process personal data about you.

Your Personal Data may be collected in the following instances: 

  • during the registration of a learner for a program offered by SMS;
  • when requesting contact, especially to receive information about programs and services provided by SMS;
  • in the creation of a commercial profile with SMS;
  • through various forms on SMS websites;
  • upon your subscription to our newsletter;
  • through the communication of information provided by phone, mail, email, or through one of our paper forms;
  • during Forums, Master classes, exhibitions, via electronic or paper forms filled out by a prospect or learner of SMS;
  • in the course of the execution of the relationship we have with you;
  • through the use of our website.

SMS may collect your data directly or indirectly, through other entities of the Planeta Group.

The following categories of personal data about you may be collected:

  • Identity data: name, first name, nationality, phone number, email, postal address, date of birth, country of residence, passport photo, and any visa-related requests; 
  • Professional data: level of education and field of initial training, obtained diplomas, professional experiences, and addresses of different employers where these professional experiences were gained, data related to your skills and interests; 
  • Financial data, including banking details, related to the payment of registrations and requests for scholarships, or financing agreements for continuing education; 
  • Data related to comments/questions collected during the pre-contractual or contractual relationship with SMS; 
  • Connection data: IP address, technical information, and location data generated in the course of using our websites and applications;

These data are collected based on the services you use and the relationship you have with us. When we need to collect personal data about you (as part of a legal obligation or a contract we have entered into with you, or that we intend to enter into with you) and you do not provide this personal data when requested, we may not be able to provide you with the services you desire. In the various forms on the SMS website, the mandatory nature of the personal data to be provided is indicated during collection by asterisks.

When you provide personal data about yourself, you commit to providing accurate information that does not harm the interests or rights of third parties.

What is the purpose of processing your personal data?  

The purpose of processing corresponds to the objective pursued by the use of your data. SMS ensures to only collect personal data about you that is strictly necessary for the purposes pursued. In the event that we wish to use your data for purposes other than those for which your data was initially collected, we commit to informing you in advance and, if necessary, obtaining your consent for any new purpose. SMS collects your personal data for the following purposes:

  • Managing the business relationship with the learner and, if necessary, their legal representative (including tracking the learner's application, whether accepted or not, registration, and monitoring of the learner's training on administrative, academic, and financial levels);
  • Managing and recovering unpaid invoices;
  • Handling disputes;
  • Organizing statistical surveys, especially for the Ministry of Higher Education and Research, and organizations publishing rankings for which SMS must produce statistics or respond to surveys in accordance with applicable legislation;
  • Video surveillance to ensure the security of learners, staff, contributors, and SMS premises;
  • Improving navigation on the SMS website;
  • Involving the learner in SMS alumni networks;
  • Creating a commercial profile for conducting business prospecting;
  • Promoting SMS and the programs offered by SMS.

Use of your data for commercial prospecting purposes 

SMS will process your personal data to offer you its products and various services related to the training it provides. In the event that we wish to use your data for purposes other than those for which your data was initially collected, we commit to informing you in advance and, if necessary, obtaining your consent for any new purpose.

SMS may also use your data to send you commercial communications about products and services similar to those you have subscribed to with us. Our communications may occur by mail, phone, SMS, in person, and/or email, throughout the duration of your training and for a period not exceeding 3 years from the end of our commercial relationship. Beyond this period, we commit to seeking your consent to continue sending you our commercial communications about products and services similar to those you have subscribed to with us.

Subject to your explicit consent, SMS may create a "Commercial Profile":

This commercial profile will be created from the information and personal data you have directly or indirectly provided to us based on information obtained regarding your consumption and browsing habits. This information and personal data may also be collected from third parties through various social networks (especially when you log in using credentials specific to these social networks).

In this case, we may send you commercial communications about our products and services or those of third-party companies.

Furthermore, subject to your explicit consent, we may disclose your personal data and your "commercial profile" to all entities of the Planeta Group so that they can also create a commercial profile and send you personalized commercial communications about their products and/or services similar to those subscribed to with SMS and those of third-party companies.

The prospective offering of products and services from our own and/or third-party companies, as well as the creation and transfer of commercial profiles and your personal data to companies within the Planeta Group, constitute additional processing based on consent, which is requested from you. The withdrawal of this consent does not affect the continuation of your relationship with us.

In any case, third-party companies outside the Planeta Group, which may be the subject of commercial communications you receive from us, will be companies operating in the same sectors as those of the Planeta Group entities mentioned earlier. They may also operate in the sectors of telecommunications, banking, finance, travel, technology, and legal activities.

For how long will your data be retained? 

SMS will retain personal data for the duration necessary to achieve the processing purposes, and/or comply with legal and regulatory obligations, and/or establish, defend, or exercise legal rights. 

During this period, SMS takes all necessary precautions, considering the nature of the data and the risks presented by the processing, to maintain confidentiality and security. This includes preventing data from being altered, damaged, or accessed by unauthorized third parties (physical protection of premises, authentication processes for individuals accessing data with personal and secure access using confidential IDs and passwords, secure https protocol, logging and traceability of connections, encryption of certain data, etc.). 

Once the services are provided, SMS will delete the user's personal data, except for personal data that needs to be retained to enable SMS to comply with a legal or regulatory obligation and/or establish, defend, or exercise legal rights, in accordance with civil and commercial prescription rules.

What is the legal basis for the processing of your data?  

The legal basis for the processing of your personal data is the execution and maintenance of our commercial relationship with you, compliance with a legal or regulatory obligation, legitimate interest, explicit consent, if applicable, that you have given us for processing involving the sending of our own commercial communications and/or communications from third-party companies, the creation of commercial profiles, and the transfer of these data and profiles to benefit companies of the Planeta Group for the purposes specified in the previous paragraph "What is the purpose of processing your personal data?"

We inform you that the personal data required at the time of your registration on the user platform, as well as those provided by phone, email, mail, or in our paper forms, whose purpose does not rely on obtaining your consent, are strictly necessary to formalize and manage our relationship with you. Therefore, failure to provide such information will prevent us from maintaining this relationship.

As mentioned earlier, the prospective offering of products and services from our own and/or third-party companies, as well as the creation and transfer of commercial profiles and your personal data to companies within the Planeta Group, constitute additional processing based on consent, which is requested from you. The withdrawal of this consent does not affect the continuation of your relationship with us.

Who are the potential recipients to whom we may disclose your data?  

SMS strives to offer you the best services and, for this purpose, may share your data with:

a. Internally:

  • A limited number of authorized individuals and services within SMS (namely, all employees working in the communication, administrative, logistical, and IT services, responsible for facilitating and managing customer relations).

 b. To third parties:

  • Association of SMS Alumni;
  • Organizations related to student life such as Cnous, Crous, student insurance companies, Ile de France Region;
  • Official bodies (including the Ministry of Higher Education and Research, education, labor, among others, operators of skills – OPCO and/or France compétences, the Regional Education Authority, the Conference of Grandes Écoles),
  • Funding organizations in the field of vocational training (such as OPCO);
  • The organization in charge of the national directory of professional certifications (France Compétences);
  • Companies where the learner may undergo an internship or other apprenticeship training;
  • Higher education institutions located in France or abroad as part of partnerships or the learner's mobility paths;
  • IT service providers and other third-party service providers providing services to SMS;
  • Organizations responsible for ranking SMS, whether or not responding to a legal obligation of SMS;

Transfer of Personal Data outside the European Union 

Your data may be transferred to a country outside the European Economic Area (EEA), especially if you decide to participate in international exchange programs. SMS ensures that no transfer of personal data is made by itself or by its partners or subcontractors to a country outside the EEA or to an international organization without a decision of adequacy made by the European Commission or the implementation of appropriate and adequate safeguards to ensure the security and protection of personal data.

What are your rights when you provide us with your data?  

In accordance with the amended Data Protection Act of January 6, 1978, and Articles 15 and following of Regulation (EU) 2016/679 on the protection of personal data, you have the following rights regarding your data: the right of access, the right to rectification, the right to erasure (right to be forgotten), the right to object to the processing of your data, the right to restriction of processing, and the right to data portability.

You can also withdraw your consent at any time and without charge. You also have the option to define directives regarding the storage, erasure, and communication of your personal data after your death.

In the event of a breach of the above provisions, you have the right to lodge a complaint with the competent supervisory authority (in France, the CNIL: www.cnil.fr).

How to exercise your rights? 

To exercise these rights, you should provide us with your contact details (name, first name, email address you provided to us) and a legitimate reason when required by law (especially in the case of objection to processing). Please note that if the information you provide does not allow us to confirm your identity or if there is a reasonable doubt, we may ask you to provide additional information or documents.

You can lodge a complaint with a supervisory authority and have the right to judicial recourse if you believe that your rights have been violated or if the supervisory authority does not respond to your complaint. 

In accordance with Article 6-II of the law of June 21, 2004, on Confidence in the Digital Economy, data that can identify you may be communicated to the judicial authority when required. 

What security measures do we implement to protect your data? 

We take necessary measures to ensure that your personal data collected through the website is not lost, diverted, accessed, modified, or disclosed by unauthorized third parties. To achieve this, we have implemented technical measures (such as firewalls) to protect your data against unlawful or accidental destruction, modification, loss, misuse, and unauthorized access, modification, or disclosure. 

In addition, organizational measures (such as access management systems) help maintain the confidentiality of your data. Access to your personal data is strictly limited to authorized SMS personnel, partners, and subcontractors who act according to our instructions and in compliance with our contractual provisions and applicable legislation.

When significant changes are made to the Policy, we will inform you by posting an online notice and/or in our premises, or by sending you an email a reasonable time before it takes effect.
